These two requirements are mandatory and the rental agency will be strict about them, as it’s the law in Malta.
If you are under 21 and/or do not have a driver’s license, you can still be a passenger. But don’t try switching seats with the driver during your ride because in case of an accident, you would face serious issues (a fine of several thousand euros, in addition to the damages).
